Disclaimer & Terms of Use

This Disclaimer governs your access to and use of the Protech-T application and related services (the “App”), provided by Protech-T AB (“we,” “us,” or “our”). By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Disclaimer in its entirety. If you do not agree, do not install or use the App.

1. Lawful use only — your sole responsibility

The App is a privacy and data-security tool intended solely for lawful personal use to protect your own legitimate data. You are solely and exclusively responsible for how you use the App and for all content, data, and activity you create, store, transmit, or access through it.

You agree that you will not use the App to:

• violate any applicable local, national, or international law, regulation, or court order;
• store, conceal, transmit, or distribute any material that is unlawful, or that constitutes or facilitates a criminal offense;
• conceal, destroy, or tamper with evidence, or obstruct any lawful investigation or legal process;
• infringe the rights of any third party; or
• circumvent encryption import/export controls or sanctions applicable to you.

We do not monitor, access, review, or control any data you store in the App, and we have no technical ability to do so. You bear full and exclusive legal responsibility for your conduct and your content. Any misuse of the App is your act alone, and we expressly disclaim all responsibility and liability for it.

2. No warranty — provided “as is”

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or immune from unauthorized access, loss, or compromise, nor that any security feature will prevent every form of attack, forensic analysis, or compromise. No security measure is absolute.

3. Data loss — encryption is irreversible by design

You understand and accept that the App is designed so that no one — including us — can recover your data without your passcode.

• Your data is encrypted with a key derived from your passcode. We never receive, store, or have access to your passcode or your encryption key.
• If you forget your passcode, your data is permanently and irrecoverably lost. We cannot reset it, bypass it, or recover your data under any circumstances.
• The App may include a panic/duress code and other features that permanently and irreversibly erase all stored data. Activation — whether intentional, accidental, or by another person — destroys data beyond recovery.
• Other events (device loss, damage, OS updates, uninstallation, configured auto-wipe, geofence, or remote-wipe features) may also result in permanent data loss.

You are solely responsible for safeguarding your passcode and for maintaining your own independent backups of any important data. To the maximum extent permitted by law, we disclaim all liability for any loss of, or inability to access, data.

4. Assumption of risk

You acknowledge that you use the App at your own risk and that you assume full responsibility for any consequences arising from your use, including loss of data, reliance on the App’s security features in adverse situations, and the legal consequences of your own conduct.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROTECH-T AB, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) EUR 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law. Nothing in this Disclaimer excludes or limits our liability for fraud, for gross negligence or wilful misconduct, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

6. Indemnification

You agree to indemnify, defend, and hold harmless Protech-T AB and its owners, officers, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to (a) your use or misuse of the App, (b) your data or content, (c) your violation of this Disclaimer, or (d) your violation of any law or the rights of any third party.

7. Export controls & sanctions

The App contains encryption and is subject to export-control and sanctions laws, including Regulation (EU) 2021/821 (the EU Dual-Use Regulation) and the U.S. Export Administration Regulations (EAR). You represent that you are not located in, and will not use or export the App in violation of, any applicable embargo, sanction, or restriction, and that you are responsible for compliance with all import, use, and export laws applicable to you.

8. Third-party platforms & device security

The App runs on hardware, operating systems, and platforms we do not control. We are not responsible for vulnerabilities, data loss, or compromise arising from your device, operating system, jailbreaking, malware, or third-party software, or from any act of a third party who gains access to your device.

9. Changes

We may update this Disclaimer at any time. Material changes will be reflected here with a new “last updated” date. Continued use of the App after changes take effect constitutes acceptance of the revised Disclaimer.

10. Severability

If any provision of this Disclaimer is held invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11. Governing law

This Disclaimer is governed by the laws of Sweden, where Protech-T AB is established, without regard to its conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence — including, for users in the European Union, mandatory EU and national consumer-protection law, and, for users in the United States, any non-waivable rights under applicable federal or state law. Nothing in this Disclaimer limits those rights.
